Alabama’s statute of repose in construction defect cases

Although the statute of limitations allows a plaintiff two years to file a suit for personal injury or property damage arising from a construction defect, the Alabama statute of repose bars lawsuits over alleged defects in construction if the improvement in question has stood for seven years prior to injury or losses occurring. There is an exception, however, in cases where an architect, engineer, or builder knew the defect existed prior to the seven-year period expiring and failed to disclose the defect.
